CMS DELAYS IMPLEMENTATION OF SECTION 111 MANDATORY REPORTING TO JANUARY 1, 2011

MMSEA, Section 111 Background
In December 2007, the Medicare Medicaid, and SCHIP Extension Act of 2007 (MMSEA) was erected to include the newest of numerous Medicare Secondary Payer Act (MSP) amendments, Section 111. The ultimate underlying goal of this legislation is to improve enforcement of the MSP. The MMSEA broadly regulates insurance carriers and group health plans by aggressively pursuing those instances in which Medicare should not be a primary payer. Section 111 has added a new mandatory reporting requirements for group health plans (GHP) and for liability insurance (including self-insurance), no fault insurance, and workers’ compensation. On or after January 1, 2011 MMSEA will require that these
providers report certain details about claims involving Medicare beneficiaries to CMS.
